Welcome to The Four Percent (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, mobile application, digital content, membership programs, fitness training services, and related offerings (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.
By using the Services, you represent that you have the legal capacity to enter into these Terms.
If accessing on behalf of a minor, you accept full responsibility for their use of the Services.


2. Memberships & Programs
Subscriptions: Our memberships and programs (e.g., (FOUR)ward Framework, Catalyst, Breakthrough) are billed on a recurring basis until canceled.

Cancellations: You may cancel anytime through your account. Cancellations take effect at the end of the current billing cycle.

Refunds: All sales are final. Refunds may be issued only at our discretion or where required by law.

Access: Programs are for personal use only and may not be shared, transferred, or resold.


3. Use of Services
You agree to use the Services for lawful purposes only.

You may not:
Copy, distribute, or modify our content without written permission.
Use the Services to harass, harm, or impersonate others.
Attempt to hack, disrupt, or interfere with the operation of our website or app.


4. Health Disclaimer
Not Medical Advice: The Services provide fitness, nutrition, and wellness information for educational purposes only. They are not medical advice.

Consult Your Physician: Always consult your doctor before beginning any exercise or nutrition program.

Assumption of Risk: You voluntarily assume all risks related to physical activity, injuries, or health outcomes from participation in our Services.


5. Intellectual Property
All content, including but not limited to workouts, videos, text, logos, images, and designs, is owned by The Four Percent and protected under intellectual property laws.

You may use the Services only for personal, non-commercial purposes.


6. Payment & Billing
Prices are listed in U.S. dollars unless otherwise stated.

We reserve the right to change pricing with notice.

You authorize us (or our third-party payment processor) to charge your payment method on a recurring basis for subscriptions.


7. Termination
We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to the Company or its community.

Upon termination, your right to access Services will immediately cease.


8. Limitation of Liability
To the fullest extent permitted by law, The Four Percent is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to injury, illness, or financial loss arising from your use of the Services.



9. Indemnification
You agree to indemnify and hold harmless The Four Percent, its affiliates, and staff from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.



10. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.



11. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

Any disputes shall be resolved in the courts of Delaware.


12. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted with an updated “Effective Date.” Continued use of the Services means you accept the changes.
